How 10.000 EUR (and almost 50k) were taken from us: We attempted to buy an apartment with this agency, which was promoted via idealista. On the day of to the viewing we were suddenly told over the phone, that the apartment would cost 35.000 EUR more than advertised on the platform. We visited the property anyway, made an offer and were told that the seller “didn’t believe” in standard procedures around preliminary purchase and sale agreements and instead of transferring an amount to reserve the property we were asked to transfer 10% of the value. During the negotiations of the sales contract, any common clauses that protect the buyer were taken out, even frases that obligated the seller to simply supply necessary documentation to the bank were not accepted. Our bank told us later, that they had never seen such a contract. When we indicated worries and insisted in keeping standard protections, we were suddenly told we had to sign immediately, or else the owners cousin would buy the property. We agreed to transfer 10k first before transferring the remainder of the 10% a week later, went ahead and opened a bank account with the bank that gave us the best conditions. Upon receiving the energy certificate, it did not match the advertised classification of C, but instead was actually E, which is less than optimal for an apartment without central heating. Despite all of the above, we transferred 10.000 EUR to the seller upon the promise that all documentation had already been submitted to our bank. When arriving at the bank to finally sign the mortgage, we were told that there were documents still missing despite having been told earlier there weren’t. Documents that could easily have been supplied at the very beginning, such as the proof that no money is owed to the condomínio. This happened at the time we were asked to transfer the full 10% to the seller. Of course we did not feel comfortable to transfer that amount without any contractual protection or even any legal obligation for the seller to even supply the required documents. The response we got from the seller was a wish of luck for our property search and that they would now sell to their cousin and kept the money. Besides the fact that 10.000 EUR were kept without relating to any damages, exchange of items or other justification, the sheer arrogance and self-righteous we encountered during this process are staggering.
